JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report that one day prior to the alleged occurrence petitioners went at the house of the informant and misbehaved with the sister of deceased which was protested by the deceased and the deceased threatened for convening a panchayat and, furthermore, on the alleged date of occurrence one co-accused Md. Bakar Ansari came at the house of the informant and took the deceased from his house and it would appear from the impugned order that one witness namely, Abdul Salam, has stated that on the alleged date of occurrence, he had talked to the petitioner no. 1 on his mobile

Patna High Court Cr.Misc. No.34757 of 2015 (2) dt.21-08-2015 2/2 phone through his mobile phone and petitioner no.1 had told him that the deceased, Md. Bakar Ansari and petitioner no.2 are with him.

Taking note of the aforesaid fact as well as submissions of the parties, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Katihar, in connection with S.T. No.146 of 2015, arising out of Barari P.S. Case No.48 of 2015.
