The petitioner Md. Subhan Miyan @ Subhan seeks bail in Forbesganj P.S. Case No. 345 of 2011, registered for the offences punishable under Sections 392 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the supervision note and not from the mouth of any of the witnesses. Other accused persons Md. Arshad, Nehal @ Zulfi, Sunny Singh @ Sani Singh, Suraj Yadav @ Tuntun Yadav, Mantosh Manjhi and Md. Firoj Alam @ Firoz have already been enlarged on bail.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.31118 of 2014 (3) dt.12-01-2015 allegation made against the petitioner, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 345 of 2011.
