27-07-2016 Heard Sri S. K. Lal, learned counsel, who was assisted by Sri Pramod Kumar, learned counsel for the petitioner and Sri Shyam Kumar Singh, learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier by order dated 01-12-2015 passed in Cr. Misc. No. 52077 of 2015, the prayer for bail was rejected. The petitioner is in custody since 31-05-2015.

In this case, earlier a report was called for by order dated 29-06-2016, which has been received and kept at flag 'Y'. On going through the report, it is evident that till date charge has not been framed and against two accused persons for their appearance summon has been issued.

In view of report of the learned Addl. Sessions Judge,

Patna High Court Cr.Misc. No.21651 of 2016 (4) dt.27-07-2016 2/2 Patna City at flag 'Y' as well as period of custody, let the petitioner namely Md. Jawed be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City, Patna in connection with Alamganj P.S. Case No. 133 of 2014, with condition that one of the bailor must be blood relation of the petitioner and secondly, during trial, the petitioner shall remain physically present on each and every date. If continuously on two dates, without prior permission of the trial court, petitioner remains absent, his bail-bond shall stand automatically cancelled. (Rakesh Kumar, J.) Anay U T
