JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 08-03-2017 Seen the report submitted by learned lower court. Taking into account the totality of the event and further, the conduct of the delinquent Umesh Kumar Sinha, Director, Forensic Science Laboratory, Patna who had presented himself before the learned lower court for evidence which had already been recorded, the supplementary show-cause is accepted and on account thereof, is exonerated with a warning to be cautious in future over compliance of the order of the Court and accordingly, his personal appearance is dispensed with.

Considering the report submitted by the learned lower court, it is apparent that all the prosecution witnesses have already been examined. That being so, in case there happens to be

No.31743 of 2016 (13) dt.08-03-2017 2/2 active cooperation of the petitioner/ accused then in that event, the learned lower court will proceed with the trial on day to day basis and conclude the same by 31st March, 2017 and for that, office is directed to communicate upon the learned lower court at once who will submit its report after disposal of the trial within the aforesaid stipulated time.

With the aforesaid observation, the instant petition is disposed of.
