2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 103 and 3(5) of the B.N.S.

3. The case of the prosecution is that the petitioner along with others being armed with sword, farsa and knife started assaulting Dabloo Singh (husband) of the informant. It is alleged that Nitin Kumar Singh attacked upon abdomen of Dabloo Singh. Satendra Singh @ Kunnu Singh assaulted Dabloo Singh with rod on his abdomen causing cut injury and due to that intestine and kidney came out. After the arrival of

Patna High Court CR. MISC. No.4841 of 2025(2) dt.28-02-2025 2/3 the co-villagers the accused persons fled away from the place of occurrence. Thereafter Dabloo Singh was taken to PHC, Dighwara where the Doctor declared him dead.

Learned counsel appearing on behalf of the petitioner has submitted that there is specific allegation of assault against Nitin Kumar Singh and Satendra Singh, though the petitioner has been arrayed as an accused, there is no specific allegation against her. She had earlier filed anticipatory bail but as she was arrested, her petition for anticipatory bail was withdrawn. The petitioner is a lady having no criminal antecedent. She is in custody since 03.11.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of J.M. 1st Class, Saran, Chapra in connection with Dariyapur P.S. Case No. 457 of 2024.

7. Accordingly, the present bail application stands allowed.
