JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Turkoulia P.S.Case No. 730/2015, disclosing offences under sections 406, 419, 420, 467, 468, 471, 506, 387, 120B/34 of the Indian Penal Code.

Complaint petition lodged on 22.9.2015 is the basis for registration of the present First Information Report alleging that the petitioners induced the son of the complainant to deliver Rs.10 lacs in order to ensure his sons employment and handed over to him a fake appointment letter.

It is submitted on behalf of the petitioners that much before

Patna High Court Cr.Misc. No.22990 of 2016 (2) dt.25-05-2016 lodging of the present complaint case, petitioner no.1 had filed an F.I.R. being Turkoulia P.S.Case No. 671/2015 on 12.9.2015 alleging that the sons of the complainant had cheated the petitioners and others of an amount of Rs.20 lacs in the name of securing their employment. It is submitted on behalf of the petitioners that the present F.I.R. is a counter blast to the previous F.I.R. lodged by petitioner no.1, in which the police have already submitted charge sheet.

Considering the above, this application is allowed. Let the petitioners, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in Turkaulia P.S.Case No. 730/2015. This is subject to the condition that the petitioners shall present themselves before the police/ court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
