JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Gwalpara P.S. Case No. 15 of 2010, registered under Sections 302, 307, 120(B)/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 / 4 of the Explosive Substance Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in the confessional statement of co-accused Md. Jafar as detailed in para 92 of the case diary, who also disclosed the name of Md. Alam, and Deepak Kumar @ Luchho, who have already been granted bail by a co-ordinate Bench of this Court vide order dated 24.01.2011 and 22.12.2010 passed in Criminal Misc. No. 44542 of 2010 and Criminal

Patna High Court Cr.Misc. No.21803 of 2016 (4) dt.27-07-2016 2/2 Miscellaneous No.41745 of 2010, respectively. The petitioner is in custody since 08.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Uda-Kishunganj, Madhepura in connection with Gwalpara P.S. Case No. 15 of 2010. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
