Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code as well as section 27 of the Arms Act.

Petitioner is not named in the first information report but in course of investigation, some witnesses stated that the petitioner had also participated in the alleged crime.

Moreover, there is specific allegation of opening fire against FIR named accused Neeraj Singh, Manoj Rai, Sonu Singh and Nakat Gope.

It is pointed out that having more or less similar allegation one co-accused Robin Kumar has already been granted privilege of bail by a coordinate bench of this court.

Taking note of the aforesaid submissions as well as facts

Patna High Court Cr.Misc. No.21497 of 2016 (2) dt.20-05-2016 and circumstances of the case, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Neeraj Kumar Tyagi, Judicial Magistrate, Ist Class, Patna in Rajiv Nagar P.S.
