The petitioners apprehend their arrest in Chenari P.S. Case No.104 of 2018 registered under Sections 147, 149, 341, 323, 354(B), 504, 506 and 379 of the Indian Penal Code. The informant named the petitioners and alleged that they all having armed with different weapons surrounded the informant at their door and on the orders of Ganesh Kahar and Rajendra Kahar to kill the informant, the accused persons assaulted the informant. Santosh Kahar and Ganesh Kahar

Patna High Court Cr.Misc. No.6470 of 2019(2) dt.06-02-2019 2/2 assaulted the informant with garasa on his head. They also assaulted the mother and other family members of the informant and took away different articles.

Learned counsel for the petitioners submits that Chenari P.S. Case No.103 of 2018 is lodged on behalf of the petitioners. Both sides are co-sharers and neighbours. On account of some petty dispute, the occurrence took place and now the case has been compromised. The Investigating Officer did not submit case-diary nor any injury report was obtained. Having considered the fact that there is a case and counter case and both sides are neighbours and the case has been compromised, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Chenari P.S. Case No.104 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Harish/- (Prabhat Kumar Jha, J) U T
