JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 20-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Katihar Town P.S. Case No. 664 of 2015 registered under Sections 395 and 397 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the case was registered against unknown and no incriminating article has been recovered from possession of the petitioner. It is further submitted that the petitioner has got no criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence, if bail is granted to him.

Patna High Court Cr.Misc. No.21830 of 2016 (2) dt.20-05-2016 2 / 2 Learned counsel for the State has opposed the application for grant of bail. He has submitted that the name of petitioner has transpired in course of investigation on the basis of CCTV footage showing the active participation of the petitioner in the alleged crime.

Regard being had to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. (Ashwani Kumar Singh, J.) Sanjeet/- U T
