The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a) and 41(1) and

(2) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the F.I.R., the petitioner was caught and 6000 litres of spirit was recovered from the truck. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or vehicle. He has been falsely implicated in the case. He is in custody since 10.9.2020 and has no criminal antecedent.

No.15828 of 2021(2) dt.06-08-2021 2/2 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Motipur P.S. Case no. 220 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur on the following conditions:

(1) One of the bailors shall be the family member of the petitioner.
