JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-04-2022 Pursuant to the order dated 02.03.2022, the Director General (HQ), Bihar has taken a decision with regard to grant of ACP/MACP to the deceased husband of the petitioner no. 1.

Patna High Court MJC No.272 of 2019(8) dt.27-04-2022 2/3 Learned counsel for the State has also filed an affidavit by way of 4th supplementary show cause on behalf of Superintendent of Police, Sitamarhi. It is stated in paragraph '4' of the said affidavit that for purpose of release of the gratuity amount of the petitioners the steps were taken to do the needful. A photo copy of CFMS generated application and PPO Order have been annexed as Annexure 'A' and 'B' to the 4th supplementary show cause. Copy of the order dated 16.03.2022 of IG (HQ) with regard to grant of ACP/MACP has been enclosed as Annexure 'C'.

In paragraph '6', a statement has been made that gratuity amount of Rs. 9,50,169/- has been disbursed in the savings account of petitioner no. 1.

Learned counsel for the State, thus, submits that the entire order of which contempt has been alleged has been fully complied with.

A rejoinder has been filed on behalf of the petitioners in which certain issues have been raised with regard to the benefits which are still payable to the petitioners. On perusal of the entire materials, this Court is satisfied that there is a substantial compliance of the judgment of this Court. Learned counsel for the State has assured this

Patna High Court MJC No.272 of 2019(8) dt.27-04-2022 3/3 Court that the benefits flowing from Annexure 'C' with regard to grant of ACP/MACP shall be made available to the petitioners within two months from today, if not already paid by now.

So far as any other grievance of the petitioners is concerned, the petitioners will be at liberty to raise such issues before the competent authority within a period of four weeks pointing out non-compliance of any part of the order and if such representation is made to the competent authority within the said period, a reasoned order thereon shall be passed to satisfy the petitioners and the same shall be communicated to them. So far as this application is concerned, it stands disposed of accordingly.
