JUSTICE AMARESH KUMAR LAL ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 406 and 471/34 of IPC. Allegation is that the informant came in contact with one Tulsi Mandal near Railway Station, Bhagalpur, who told the informant that he know some persons, who used to double the money. Thereafter, the informant was introduced with nine persons, including this petitioner, who demonstrated about process of doubling the money. The informant developed his faith upon them and gave Rs. 2 lacs to them then the accused persons, including this petitioner, changed the money saying to open this packet at your house otherwise this money will not become double

Patna High Court Cr.Misc. No.31075 of 2015 (2) dt.18-08-2015 2/3 and when the informant came to his house and opened the bundle, he found only bundle of plain papers.

It is submitted that the petitioner has been implicated in this case only on suspicion without levelling any specific allegation. In similar facts and circumstances, co-accused Jamiruddin has been granted bail vide Cr. Misc. No. 46850 of 2013 (Annexure-2).

Learned counsel for the State submits that the petitioner has also criminal antecedent. After investigation, the case has been found true.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Ms. Saba Alam, Judicial Magistrate, 1st Class, Katihar/court concerned after framing of charge in Manihari P. S. Case No. 137 of 2013 (G.R. No. 2125 of 2013) with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each

Patna High Court Cr.Misc. No.31075 of 2015 (2) dt.18-08-2015 3/3 and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
