JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-01-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the Informant. The petitioner apprehends his arrest in connection with C.A. Case No. 1256 of 2017 registered under Section 498 (A) of the Indian Penal Code.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against him. Petitioner has no criminal history.
Learned A.P.P. appearing on behalf of the State and learned counsel for the informant opposed the prayer of the petitioner by contending that petitioner is the husband of the
Patna High Court CR. MISC. No.15677 of 2021(4) dt.24-01-2022 2/2 complainant(informant). There is allegation of torturing both mentally and physically against the petitioner to the complainant. Further he submits that there is also allegation of demand of dowry against the petitioner. Hence, petitioner does not deserve to be enlarged on anticipatory bail. Having considered the facts and the submissions made on behalf of the parties, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
