====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Kadamkuan P.S. Case No. 337 of 2018, instituted for the offence under Section(s) 364A and 120B/34 of Indian Penal Code.

It is alleged in the written report that on 16.6.2018 the driver of the informant namely Mukesh Singh along with his associates Jamil Akhtar Subhani and 5-6 other accused persons took father of the informant for visiting Rajgir, Mundeshwari and Deo. It is further alleged that from Mobile Phone of his father, the driver Mukesh Singh informed that 5-7 persons captured his father. He told the informant to deliver Rs.5,00,000/- otherwise his father would be killed. It is further alleged that Mukesh Singh, Jamil Akhtar Subhani along with

Counsel for the petitioner submits that mere suspicion has been raised against the petitioner in the written report. He further submits that other co-accused persons with similar allegation have already been granted bail by this Court as well as coordinate Bench of this Court vide orders dated 9.1.2019 and 18.12.2018 passed in Cr. Misc. 74212 and 76034 of 2018 respectively.

Petitioner is in custody since 19.6.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Om Prakash, learned Additional Chief Judicial Magistrate-VII, Patna, in connection with in Kadamkuan P.S. Case No. 337 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
