Petitioner seeks bail in a case registered for the offence punishable under Section 364 of the Indian Penal Code. The husband of the informant went from his house along with this petitioner and thereafter, he did not return. Hence, F.I.R. was lodged regarding abduction of the husband of the informant.

Submission of the learned counsel for the petitioner is that petitioner is in custody since 15.05.2018. Investigation of the case is already complete and nothing has come during investigation to substantiate involvement of the petitioner, nor anyone has seen the petitioner along with husband of the

Patna High Court CR. MISC. No.7941 of 2019(3) dt.26-04-2019 2/2 informant at any point of time. In fact both were in the same business and for business dispute, petitioner has been falsely implicated.

Considering the nature of allegation and the material after investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Karai Parsurai Police Station Case No.93 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
