The petitioner is accused in connection with Bidupur P.S. Case No. 207 of 2015, registered under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been surfaced in the confessional statement of Nitesh Kumar, except the confessional statement there is no tangible material against the petitioner to show his involvement in the present case. Further submission is that informant claimed to identify the culprit on seeing them again, but petitioner has not been put on T.I.P as yet, while he is in custody since 16.02.2016.
Patna High Court Cr.Misc. No.20771 of 2016 (2) dt.18-05-2016 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 207 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
