====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Nagarnausa P.S. Case No. 78 of 2018, instituted for the offence under Section(s) 376, 511 of the Indian Penal Code and Sections 4/18 of POCSO Act. It is alleged in the written report that three years old grand-daughter of the informant had gone to Anganbari Kendra where this petitioner after giving money took her to Khand of Ramadhin Prasad and told to put off her pant. She raised alarm then wife of Binod Chaudhary as named in the written report arrived and told about the occurrence. The informant along with his family members went to the place of occurrence, but petitioner on seeing them fled away. Case diary has been received.
Patna High Court Cr.Misc. No.2476 of 2019(3) dt.08-02-2019 2/2 The statement of victim girl recorded under Section 164 Cr. P.C. is available in paragraph-33 of the case diary wherein she has stated that petitioner has removed her pant, but he did not commit any illegal act with her.
Petitioner is in custody since 13.7.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st-cum Special Judge, Nalanda at Biharsharif, in connection with Nagarnausa P.S. Case No. 78 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
