ANJANA PRAKASH ORAL JUDGMENT Date: 02-07-2015 The Petitioner seeks revision of the judgment dated 15.1.2015 passed by the Additional District and Sessions Judge Vth, Patna City in Criminal Appeal No.101 of 2011, by which he has confirmed the conviction and sentence of the Petitioner passed on 23.3.2011 by the Judicial Magistrate, 1st class, Patna City in G.R. case No.1983 of 2008 (Trial No.779 of 2010/667 of 2011). It has been submitted that the maximum sentence has been awarded for a period of one year whereas the Petitioner has remained in custody for almost 11 months.
Having considered the period of custody of the Petitioner, the sentence is modified to the period already undergone by him. However, he is required to deposit the fine as directed by the
Patna High Court CR. REV. No.281 of 2015 dt.02-07-2015 2/2 Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
