The petitioner in the present case is seeking regular bail in connection with Uchkagaon P.S. Case No.235 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on mere suspicion. Learned counsel submits that nothing has been recovered from the conscious possession of the petitioner. Learned APP has opposed the prayer for bail.
Considering the facts and circumstances of the case wherein 630.720 liters of illicit liquor have been recovered from the seized vehicles and the driver of the vehicle has disclosed the

No.3722 of 2020(2) dt.21-01-2020 2/2 name of the fleeing persons including this petitioner and the petitioner is getting involved in similar offence during the period he is on bail and he is in custody only since 19.12.2019, at this stage, this Court is not inclined to grant regular bail to the petitioner. Prayer for bail is, thus, refused with liberty to the petitioner to file a fresh application after a lapse of reasonable period of custody.
