The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per allegation in the FIR, the informant was robbed of Rs. 48,000/- along with other articles as mentioned in the FIR by three unknown persons.

It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. In course of investigation the police forcibly took the signature of the petitioner on a plain piece of paper and interpolated the same into a confessional statement. The allegations of recovery of

Patna High Court CR. MISC. No.15876 of 2021(2) dt.12-08-2021 2/2 incriminating articles are false and concocted. The petitioner is in custody since 18.10.2020 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 9 months, the investigation having concluded without putting the petitioner on T.I Parade, the Court directs the petitioner to be enlarged on bail in connection with Patepur P.S. Case no. 222 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Vaishali at Hajipur.
