Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Amnour P.S. Case No. 341 of 2021 instituted for the offences under Sections 272, 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 01.01.2022 and is a person with clean antecedent.
Allegation is of recovery of 79.6 litre of liquor from the house of the petitioner.
Learned counsel for the petitioner submits that the petitioner is a lady and her house is a joint family property and,
Patna High Court CR. MISC. No.5946 of 2022(2) dt.08-03-2022 2/2 as such, she was not aware who had kept the liquor in the house. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and is a female, let the petitioner above named be released on bail on furnishing bail bond of Rs.1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Exclusive Special Excise Court, Saran at Chapra in connection with Amnour P.S. Case No. 341 of 2021.
