1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Baniyapur (Baiyanpur) Police Station Case No. 241 of 2024, dated 07.06.2024, disclosing offences under Sections 341/323/324/307/354B/379/504/506/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 05.06.2024, at about 08:30 PM, in the night, the informant's grandson was going towards village to bring milk, who was surrounded by the co-accused Shailendra Singh @ Shera Singh and told the informant's grandson that his motorcycle was stolen by him and assaulted him with knife due to which he sustained injury near his wrist

When the informant's grandson ran towards his house, the informant and other family members came outside of the house upon which all the accused persons, total 10 in numbers, arrived there and started abusing. The petitioner, along with co-accused Shailendra Singh, assaulted the informant by means of dab on his head due to which the informant sustained injury at three places.
4. Learned counsel for the petitioner submits that both the parties are agnates and there is long standing land dispute between them. There is allegation of assault against the petitioner, along with co-accused Shailendra Singh @ Shera Singh, upon the informant. He next submits that injuries sustained by the informant are simple in nature and the allegation of assault upon other family members, including the informant's grandson, are against the coaccused persons.
5. Learned counsel for the State referring to the case diary's paragraph-13 submits that injuries sustained by the informant is simple are nature.
6. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates having long standing land dispute
Patna High Court CR. MISC. No.6944 of 2025(3) dt.12-05-2025 3/3 between them, and injuries sustained by the informant are simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Saran at Chapra, in connection with Baniyapur (Baiyanpur) Police Station Case No. 241 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
