JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. 7 kg. ganja is said to have been recovered from joint possession of the petitioners who are in jail custody since 16.03.2015.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioners on bail and hence, their prayer for bail in connection with N.D.P.S. Case No. 14 of 2015 arising out of Dumariaghat P.S. Case No. 18 of 2015 pending in the court of learned Sessions Judge-cum-Special Judge, East Champaran at
Patna High Court Cr.Misc. No.30531 of 2015 (3) dt.29-10-2015 2/2 Motihari stands rejected.
However, petitioners may renew their prayer for bail after completion of one year in jail custody, if their trial is not concluded within the above stated period.
