This application has been filed for quashing of F.I.R. vide Daniyawa P.S. Case No. 99 of 2016 registered for the offences under sections 47 and 57 of the Bihar Prohibition & Excise Act, 2016.

As per the F.I.R., the Police party, on suspicion, searched the motorcycle of the petitioner in presence of two independent witness. Upon search, two bottles of foreign made liquor have been recovered from the motorcycle of the petitioner.

From reading of the F.I.R., it appears that prima facie case is made out against the petitioner. Therefore, the F.I.R. cannot be quashed.
