Petitioners are in custody connection with Excise Case No. 440 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits petitioners have no criminal antecedent and there is recovery of 172 liters of liquor in the instant case. He further submits that nothing was recovered from the conscious possession of the petitioners. The petitioners are in custody since 23.12.2019. Considering the fact that petitioner have no criminal antecedent, the Court is inclined to grant bail to the petitioners,

Patna High Court CR. MISC. No.6392 of 2020(2) dt.03-02-2020 2/2 let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge Excise, Gopalganj, in connection with Excise Case No. 440 of 2019 subject to the condition that if the petitioners are found involved in such similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioners.
