====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-02-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 467, 468, 471 and 420/34 of the IPC.

The prosecution story, in brief, is that one Sushil Kumar, Block Development Officer-cum-Member Secretary, Block Employment Unit, Marauna, submitted his written application addressed to S.H.O. of Marauna Police Station in compliance of Memo No. 17-1/Go dated 13.03.2015 of District Magistrate, Supaul, for institution of F.I.R. regarding submitting application form for selection/appointment as Panchayat

Patna High Court Cr.Misc. No.6559 of 2019(2) dt.05-02-2019 2/3 Teachers on the basis of enclosing their forged T.E.T. certificate against altogether six(6) candidates/applicants mentioning their names in the written report including petitioner at Serial No. 1. It has been submitted by learned counsel for the petitioner that the petitioner has been made accused in the present case due to mistake of fact. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner was engaged on the post of Panchayat Teacher. No wrongful loss has been caused by the petitioner. Other coaccused has been granted anticipatory bail by another Coordinate Bench of this Court vide Cr. Misc. No. 29974 of 2015 order dated 08.10.2015.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R/ complaint case.

Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Supaul, in connection with Marauna P.S. Case No. 69/2015,
