The petitioner has preferred this application for grant of regular bail in a case registered under sections 436 and 427 of the Indian Penal Code.

As per allegation in the F.I.R., over differences the petitioner sitting in the shop of the informant, it is stated that the petitioner threatened the informant that he would burn his shop and in the night shop was burnt by the petitioner. The informant states that he saw the petitioner running away. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. He has been falsely implicated in the case. He is in custody since 3.7.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Dumra P.S. Case no.128 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Dumra, District-Sitamarhi.
