====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 08-02-2019 Heard learned counsel for the Petitioner and learned counsel for the State.
In this case, the petitioner is seeking anticipatory bail in connection with Khodawandpur P.S. Case No.208 of 2018, registered for the offence punishable under Section 30 (A) of the Bihar Prohibition of Excise Act, 2016. Allegation has been made that 35 liters of country made liquor has been recovered from the wash room of the petitioner, however, learned counsel for the petitioner submits that he is not residing at that place rather he is working in Haryana, but he has not produced any material to show that he was living out side the State.
Looking to the nature of allegation, this Court is
Patna High Court Cr.Misc. No.7425 of 2019(2) dt.08-02-2019 2/2 not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
