The petitioner has been remanded in the present case on 18.01.2016 and since then he is languishing in custody in connection with Daudnagar P.S. Case No. 287 of 2013 for the offences instituted under Section 392 of the IPC. The prosecution story, in brief, is that on 20.09.2013 at about 12.00 noon while the informant was returning her home with Rs. 50,000/- meant for Indira Awas withdrawn from the P.N.B., Bhakharua and reached near Badi Canal, two riders on a motorcycle came and snatched the bag consisting of the money. She raised alarm but they succeeded in fleeing away.

No.21438 of 2016 (3) dt.01-08-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.01.2016 and the charge sheet has been submitted in the present case. The petitioner is not named in the FIR. He has not been put on T.I. Parade to ascertain his implication in the present case. There is no recovery of any incriminating article from conscious possession of the petitioner. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No. 287 of 2013.
