JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-12-2015 Heard the learned counsel for the petitioners, the learned A.P.P as also learned counsel for the Informant. The petitioners seek bail in a case for the offence punishable under section 302/34 of the I.P.C Allegedly, at the instigation of co-accused Vijay Singh both the petitioners shot the father of the informant dead and thereafter fled away.
Submission is of false implication and that there is no specific allegation as to who fired causing injury to the father of the informant. The occurrence as alleged is not true version, there is land dispute. The petitioners are in custody since 30.01.2015. Charge sheet has already been submitted and there is no chance of
Patna High Court Cr.Misc. No.30812 of 2015 (5) dt.01-12-2015 2/2 tampering with the prosecution evidence.
The learned A.P.P. duly assisted by the learned counsel for the informant opposes prayer for bail by submitting that both the petitioners are assailants and two fire arm injuries were found during postmortem and two bullets were recovered from the body.
In the facts and circumstances as stated above, considering that the petitioners are the assailants, this Court is not inclined to enlarge them on bail and accordingly their such prayer stand rejected in connection with Teghra P.S. Case No. 394 of 2014 pending in the court of C.J.M. Begusarai. (Jitendra Mohan Sharma, J) Abhay/- U T
