The petitioner has preferred this application for grant of regular bail in a case registered under sections 406, 420, 467, 468 and 506 of the Indian Penal Code wherein cognizance has been taken under section 406 of the Indian Penal Code. As per allegations in the complaint, the complainant had handed over a sum of Rs.3,45,500/ to the petitioner by cheque on the promise that the same would be returned within a few days. However, the petitioner did not return the same and hence the case.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.15843 of 2021(2) dt.12-08-2021 2/2 that the petitioner is into the business of supplying of bricks. Against the aforesaid amount, bricks were supplied to the complainant and as per the case of the petitioner still further amount remains due to be paid by the complainant to the petitioner. The petitioner has no criminal antecedent and is in custody since 16.6.2020.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Complaint Case no.359 of 2015 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
