The petitioner is seeking anticipatory bail in connection with Saraiya P.S. Case No. 334 of 2019 registered under Sections 272, 273, 414/34 of the Indian Penal Code and under Section 30(a), 32(ii), 38(ii) and 41(i) of the Bihar Prohibition & Excise Act, 2016, pending in the court of learned Special Judge, Excise, Muzaffarpur.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to enmity and nothing has been recovered from the possession of the petitioner.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the fact that the petitioner is named in the
Patna High Court CR. MISC. No.4554 of 2020(2) dt.23-01-2020 2/2 F.I.R. and he has got criminal antecedent of similar nature, this court is not inclined to grant privilege of anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is, thus, refused.
In case the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered by the court below on it's own merit and on the basis of the materials available on the record.
