The petitioner apprehends his arrest in connection with Patna Vigilance P.S. Case No.1 of 2017/Special Case No.3 of 2017 registered under Sections 420, 406, 409, 467, 468 and 120(B) of the Indian Penal Code besides Sections 13(2) read with Sections 13(1)(c)(d) of the P.C. Act.

The accusation is that on the decision of the Empowered Committee of Nagar Parishad, Siwan, solar lights were supplied by this petitioner without following the procedure of the purchase and the same were not upto the mark and the value added tax for the same were not paid properly.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.39622 of 2017 (3) dt.03-10-2017 2/2 submits that the petitioner is the supplier of the solar lights and on purchasing the same, he paid the proper value added tax as required at the time of purchasing the solar lights but the petitioner has falsely been implicated in this case with false allegation. Further submission is that the co-accused Anuradha Gupta alias Anuradha Devi, who was the Vice-Chairman of the Empowered Committee of Nagar Parishad, Siwan, has already been granted the privilege of pre-arrest bail by a Bench of this Court vide order dated 27.07.2017 passed in Criminal Misc. No.24476 of 2017. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance, North Bihar, Muzaffarpur, in connection with Vigilance P.S. Case No.1 of 2017/Special Case No.3 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
