This application for regular bail arises in connection with Excise Case No. 798 of 2019 arising out of Durgawati P.S. Case No. 296 of 2019, disclosing offences punishable under Section30(A) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The Ashok Leyland pickup vehicle from which 1451.20 liters of foreign made liquor was recovered, admittedly belongs to the petitioner. The driver was apprehended, who in his confessional statement disclosed active involvement of the petitioner in business of illicit liquor.

It appears from the statement made in paragraph 3 of the application that the petitioner has criminal antecedent,

Patna High Court CR. MISC. No.4681 of 2020(4) dt.23-06-2020 2/2 inasmuch as, he has been made accused in a case in U.P., also involving transactions in illicit liquor.

Learned counsel appearing on behalf of the petitioner has submitted that that petitioner remained in custody since November, 2019 and considering the period of custody, which the petitioner has already undergone, this Court should sympathetically consider his release on regular bail. Considering the huge quantity of illicit liquor, said to have been recovered from the vehicle belonging to the petitioner and the disclosure made by the driver about the petitioner's involvement and his criminal antecedent in another criminal case, I am not inclined to grant him privilege of regular bail. This application is dismissed.
