The petitioner seeks bail in RC Case No. 20(A) of 2017, registered for the offence punishable under Sections 420, 409 and other allied sections of the Indian Penal Code, section 13(2) read with 13(1)(d) of the Prevention of Corruption Act. As per the prosecution case, petitioner along with coaccused persons named in the FIR misappropriated amount of Rs. 95,39,100/- from sixteen accounts of N.D. Road, Sub-Post Office, Munger and another Sub-Post Office, Munger. Though petitioner was posted as Assistant in Sub-Post Office, Munger at the relevant time, but since she has not passed any departmental examination and has got no knowledge of Data Operating, the co-accused persons misused her User ID and password committed forgery. It is next submitted that

Patna High Court CR. MISC. No.5633 of 2022(3) dt.21-04-2022 2/2 suspension of petitioner has already been revoked vide order dated 05.01.2022 by the department. Petitioner is in custody since 03.12.2021 having clean antecedent. Moreover, Similarly situated co-accused have been granted bail by this Court. Investigation is complete.

However, counsel for the CBI vehemently opposed the prayer for bail and submitted that petitioner is named in the FIR and there is specific allegation of committing forgery against him.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge CBI II, Patna in connection with RC Case No. 20(A) of 2017.
