2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, three named and several other unknown accused persons committed murder of the husband of the informant.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired only on the basis of confessional statement of co-accused namely Madhu Yadav and Ajeet Kumar who have inimical terms with the petitioner due to previous dispute. Except the confessional statement, no other material is available on record to show the veracity of the petitioner in the alleged occurrence.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Bikramganj, Rohtas in connection with Suryapura P. S. Case No. 247 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
