====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 27-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Kudra P.S. Case No. 473 of 2023 dated 11.12.2023 registered for the offences punishable under Sections 461 and 379 of the I.P.C.
3. As per the prosecution case, on 10.12.2023, three unknown miscreants are alleged to have stolen Rs. 17,16,700/- in cash after cutting the ATM Machine.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner is not named in the F.I.R. His name has surfaced in the present case on the basis of the confessional statement of the co-accused Vivek
Patna High Court CR. MISC. No.4817 of 2025(2) dt.27-02-2025 2/3 Kumar who has stated that the petitioner was also involved in the alleged crime. The said confessional statement of the coaccused has got no evidentiary value in the eye of law. The petitioner has been remanded in the present case from Obra P.S. Case No. 442 of 2023 in which he has already been granted bail by the Hon'ble Cort vide Cr. Misc. No. 60120 of 2024 under order dated 18.10.2024. It is further submitted that from perusal of the F.I.R., it appears that during cutting the ATM Machine, alarm was started ringing in the concerned office, but no reaction was received by the concerned police station, which creates doubt about the prosecution case. No incriminating article has been recovered from his possession. He has no concern with the alleged offence. The petitioner has three criminal antecedents in which he is on bail as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 30.10.2024.
5. Learned A.P.P. for the State has opposed the prayer for bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.4817 of 2025(2) dt.27-02-2025 3/3 like amount each to the satisfaction of the learned J.M. Ist Class, Mohania, Kaimur at Bhabua in connection with Kudra P.S. Case No. 473 of 2023 with further condition:- I. The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
