The only thing which is required on the part of the petitioner is to show the morality and honesty towards dealing with the bank. The case is very simple. The bank is demanding money which is said to have been overdrawn by the petitioner in the account of his father which was the salary account of the father of the petitioner. The fact is that the father had died on 24.11.2012. If the petitioner has withdrawn any money which got wrongly credited to his father's account after his death and which was not due to his father, he would be liable to return the same. It requires a simple calculation and no application of mathematical formula.
Perhaps understanding the position, learned counsel
Patna High Court CWJC No.1720 of 2019(2) dt.07-02-2019 2/2 for the petitioner submits that he will reconcile the account with the bank and in case any excess amount is found to have been overdrawn, the same shall be settled and paid to the bank. This writ application stands disposed of, accordingly. The bank will furnish complete account within a period of one week from date of receipt/production of a copy of this order.
