1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Karpoorigram Police Station Case No. 17 of 2023, dated 28.03.2023, disclosing offences under Sections 302 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that informant's daughter (now deceased) was a student at Krishna Nursing Institute in Singhia, Samastipur, and used to reside in a house at Singhia. One 23.03.2023, while the informant's daughter was at home, they received a threatening call that his daughter would be murdered. After informant's son attempting to call back, no one responded, and they ignored the threat. The

No.8538 of 2025(4) dt.23-07-2025 2/3 daughter returned to her rented accommodation on 26.03.2023 and on 27.03.2023, the landlady informed the informant that her daughter was unwell. Later, police informed her that her daughter has died and asked her to come to Singhia. Upon arrival, the informant found her daughter's lifeless body lying on the ground. The landlady revealed that the petitioner had visited the deceased and stayed with her on the night of 26.03.2023 and went from there in the evening of 27.03.2023 and after some time the landlady saw deceased hanging from fan with a noose around her neck.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence in the manner alleged. The petitioner has been made accused in the present on case the basis of false and fabricated story due to malice and grudge. He next submits that informant had the knowledge about the affair between the petitioner and the deceased, which was resisted by them and they used to harass the deceased. He further submits that the deceased has committed suicide and the petitioner has falsely been implicated solely out of grief and anger by the informant, who holds him
Patna High Court CR. MISC. No.8538 of 2025(4) dt.23-07-2025 3/3 responsible for death of her daughter. Referring to the post-mortem, learned counsel submits that no external injuries has been found by the doctor and reason for death is asphyxia due to hanging.
5. On the other hand, learned counsel for the State opposes the prayer for anticipatory bail and submits that the specific allegation of murder is against the petitioner. He next submits that process of Sections 82/83 of the Code of Criminal Procedure has been issued against the petitioner.
6. Regards being had to the submissions advanced by learned counsel for the parties and taking into consideration the nature of allegation and the fact that process under Section 82 and 83 of the CrPC has been issued against the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner.
