The petitioner seeks bail in Kudwan P. S. Case No. 35 of 2014 registered for the offence punishable under Sections 147, 149, 302, 341, 323, 307 of IPC.

Learned counsel for the petitioner submits that there was occurrence of assault between the family members and there is omnibus allegation against the petitioner and others. The petitioner is the father of the deceased ( Satyendra Singh) and the counter case has also been filed for the same occurrence. Learned counsel for the State submits that there is allegation of assault against several other family members and there is specific allegation of overtact against the petitioner to

Patna High Court Cr.Misc. No.31207 of 2015 (2) dt.19-08-2015 2/2 have assaulted the deceased, when he was lying on the earth, with brick over his face and temporal region and on account thereof, said Satyendra Singh died during treatment.

Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer for bail is rejected.
