Petitioner seeks regular bail in connection with Ram Krishna Nagar P.S. Case No. 691 of 2019 registered for the offence under sections 8C, 21C, 25 and 29 of N.D.P.S. Act pending in the Court of Sessions Judge/Special Judge, Patna. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has no concern with the alleged motorcycle and the seized materials. Petitioner is in custody since 21.09.2019.

Patna High Court CR. MISC. No.14367 of 2020(2) dt.07-09-2020 -2Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that petitioner is named in the first information report and in the instant case, more than commercial quantity of brown-sugar has been recovered from the possession of the petitioner and coaccused. Further submission is that petitioner is not a man of clean antecedent. Hence, this is not a fit case for bail. Having considered the above facts and circumstances of the case and the submission advanced on behalf of the State, prayer of the petitioner for bail is rejected. However, Trial Court is directed to conclude the trial within a period of six months.
