The petitioners seek regular bail in connection with Shekhopur Sarai P.S. Case No.84 of 2018 for the offences punishable under Sections 147, 148, 149, 323 and 302 of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the father of the informant, on account of which father of the informant died subsequently during the course of the treatment. The main allegation as per the FIR of having given khanti/ iron rod blow on the father of the informant is against the co-accused, Gopal Singh, Sanjay Singh and Karnal Singh.

No.5294 of 2019(2) dt.30-01-2019 2/2 The learned counsel for the petitioner submits that though the specific allegation is against the aforesaid co-accused persons, however, the entire family members of the accused side have been made accused in the present case. It is further submitted that final form has already been submitted as regards the family members of the accused side. It is submitted that no specific allegation of any sort of overtact has been levelled against the petitioners qua the deceased father of the informant. The petitioners have a clean antecedent and are languishing in custody since 06.10.2018.

Per contra, the learned counsel for the informant appeared and opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheikhpura in connection with Shekhopur Sarai P.S. Case No.84 of 2018.
