In this case, the petitioner is seeking bail in connection with Barauni P.S. Case No. 120/2016 registered for offences under sections 273 of the Indian Penal Code and 47(A) of the Excise Act.

From a pick-up van 180 packets each containing 400 ML liquor were recovered.

The counsel for the petitioner submits that he is the owner of the pick-up van and there is a license was carrying the aforesaid liquor.

The petitioner has been apprehended on account of deviation of route through the said pick up van was moving.

Patna High Court Cr.Misc. No.21331 of 2016 (2) dt.19-05-2016 2/2 Defence has been taken that there was a short route and as such he followed that route, on that account, some technical violation is there, but cannot shifted to be violation for illegal possession of the liquor.

Looking to the nature of allegation, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 120 of 2016.
