The petitioner apprehends his arrest in Nalanda P.S. Case No. 68 of 2021, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code.
As per the FIR, this petitioner along with other coaccused persons committed theft of the truck of informant. It is submitted that petitioner has been falsely implicated in this case. No such occurrence as alleged in the FIR has taken place. Petitioner has got no concern with the alleged occurrence. Petitioner is simply a driver. Agreement was executed in between the informant and co-accused Annu Kumar and informant handed over key of the truck to co-accused Annu Kumar and he is responsible for the alleged occurrence.
Patna High Court CR. MISC. No.5919 of 2022(2) dt.01-08-2022 2/2 Counsel for State opposed the prayer for bail and submitted that petitioner has got criminal antecedents of five case more or less of similar nature.
Considering the facts aforesaid and criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
