Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is not named in the first information report and in course of investigation when statement of the victim was recorded, he named the petitioner stating that this petitioner assaulted him with lathi.

Learned Addl. Sessions Judge has referred injury of the victim and it appears that altogether five injuries were found on the person of the victim, out of them, injury nos. 1, 2 and 3 appear to have been caused by sharp cutting weapon whereas injury nos. 4 and 5 appear to have been caused by hard and blunt substance. Considering the aforesaid facts and circumstances as well as

No.33176 of 2015 (3) dt.15-10-2015 this aspect of the matter that having more or less similar allegation one co-accused Shyam Paswan has already been granted privilege of bail by a coordinate bench of this court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Bihra P.S. Case no. 51/2014.
