This application, for grant of regular bail, arises out of Raghunathpur P.S. Case No.225 of 2015, disclosing offences under Sections 379/34 of the Indian Penal Code. The petitioner is in custody since 01.04.2016. The informant has alleged in the First Information Report that the accused persons, including the present petitioner, took away his buffalo in the night when he was sleeping. He, after realizing some disturbance, got up and saw the accused persons, whereafter, he raised

Learned counsel, appearing on behalf of the petitioner, has submitted that the allegation, as made in the First Information Report, does not appear to be, prima facie, reliable.

Considering the submission, as above, and the fact that the petitioner is in custody since 01.04.2016, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Raghunathpur P.S. Case No.225 of 2015.

This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
