1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Katihar Town P.S. Case no. 845 of 2024 registered under section 30(a) of Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on information having been received, it is stated that raids were conducted in the houses of different persons. While 26.075 litres of liquor was recovered from the house of petitioner no.1, it is stated that 14.15 litres of liquor was recovered from the house of petitioner no.2.
4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated. No incriminating
Patna High Court CR. MISC. No.6137 of 2025(2) dt.24-02-2025 2/2 article has been recovered from either their possession or their house. They have no criminal antecedent.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the petitioners not having been arrested at the spot and none of the petitioners having any antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that both the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Katihar Town P.S. Case no. 845 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Exclusive Excise Court no.2, Katihar.
