JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Trial No. 3800 of 2018, arising out of Complaint Case No. 2029 of 2017 in which cognizance has been taken under Section 406 of the IPC.

Allegation is of transaction of money between the parties and the case was referred to the Mediation Committee vide order dated 7.2.2019 and the report of the Mediation Committee is at Flag 'A', which shows that the matter has been resolved between the parties as per conditions mentioned in the Memorandum of Agreement, according to which the petitioner has paid Rs.35,000/- on 8.3.2019 and the remaining amount of Rs.1,00,000/- will be paid within four months or before

Heard learned counsel for the complainant, who also conceded the facts.

In view of the above fact, this application is disposed of with direction that if the petitioner so surrenders, he will be released on provisional bail till 8.8.2019 and by that time it is expected that the petitioner shall deposit the remaining amount of Rs.1,00,000/- by way of Bank Draft payable in the name of opposite party No.2 and once the same is deposited, the bail bond of the petitioner shall be confirmed.
