In this case, the petitioners are seeking anticipatory bail in connection with Kawakole P.S. Case No. 232 of 2018, registered for the offence punishable under Sections 147, 148, 149 and 307 of the Indian Penal Code and under Section 27 of the Arms Act.
Allegation has been made that accused persons including the petitioners holding riffle and gun have surrounded the informant side and started hurling abuses and thereafter resorted to firing. It has further been alleged that Ravindra Yadav and Ramashis Yadav resorted to firing upon his son, due
Patna High Court Cr.Misc. No.2115 of 2019(2) dt.16-01-2019 2/2 to which he sustained firearm injury and fell down there. Dharmendra Yadav and son-in-law of Chando Yadav made firing upon his cousin brother, who also sustained firearm injury. It has also been alleged that these petitioners have also made firing with their respective rifle and gun. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected.
